Cumby Man Arrested for Assault Following Domestic Disturbance

HOPKINS COUNTY, TX – A Cumby man was arrested on May 28, 2025, following a domestic disturbance at a residence on Smith Street, according to law enforcement records.

35-year-old Maximiliano DeLeon-Garcia was taken into custody by Officer C. Gilbert of the Cumby Police Department. The arrest followed a call regarding an active disturbance involving Garcia and a female, identified in the report as his wife.

According to the affidavit, It was reported that she and DeLeon-Garcia were involved in an argument that escalated when DeLeon-Garcia allegedly punched her in the arm. She admitted to scratching him in return. Officer Gilbert noted visible injuries on both parties’ arms and observed blood and scratch marks on the females arm.

After speaking with both individuals and observing the evidence at the scene, DeLeon-Garcia was arrested without incident and transported to the Hopkins County Jail. He was charged with Assault Family Violence Causing Bodily Injury, a misdemeanor offense under Texas law.

All subjects are innocent until proven guilty in a court of law.
